#2018ZimElections: Chamisa files court challenge to election result

Chris Mhike, in suit, leads Nelson Chamisa's legal team into the Zimbabwean Constitutional Court to file their challenge to Emmerson Mnangagwa's electoral victory last week. "For now it has been stayed pending determination of the court challenge", Ziyambi said.

His lawyer Advocate Thabani Mpofu said they had overwhelming evidence to prove that Mr Chamisa was cheated.

The Constitutional Court, which can declare a new victor or order a fresh election, must rule within 14 days of an election petition.

The legal challenge is likely to result in a postponement of Mnangagwa's inauguration ceremony as president of Zimbabwe.

According to his draft order, Mr Chamisa is seeking the nullification of President Mnangagwa's victory and wants the court to declare him the victor.

"The inauguration is no longer going ahead (on Sunday) as planned", Justice Minister Ziyambi Ziyambi told AFP. "We have a good case and cause".

The first election since Robert Mugabe was forced to resign after a coup in November had been expected to end Zimbabwe's pariah status and launch an economic recovery but post-election unrest has reminded the country of its violent past.

By narrowly winning more than 50% of the vote Mr Mnangagwa, a member of the ruling Zanu-PF party, avoided a run-off election against Mr Chamisa. Six died after soldiers opened fire on the protesters in a response the opposition alliance called "disproportionate and unjustified".

Zimbabwe's defeated opposition faced a deadline Friday to file its legal challenge to try to overturn the July 30 election result, which has been mired in fraud allegations and a government crackdown on opponents.

Earlier this month, Mnangagwa secured a comfortable victory, according to results from the Zimbabwe Electoral Commission, polling 2.46 million votes against 2.15 million for the 40-year-old Chamisa.

On Thursday, opposition figure Tendai Biti was detained by Zimbabwean police after Zambian authorities rejected his bid for asylum.
